1. Introduction
These Terms of Service ("Terms") govern the use of the A L E K A M O I Studios website and all production services provided by the Studio.
2. Acceptance of Terms
By accessing our website or engaging A L E K A M O I Studios for any service, you agree to be bound by these Terms, together with any project-specific agreement executed between you and the Studio.
3. Services
A L E K A M O I Studios provides professional creative and production services, including but not limited to:
Commercial production
Documentary filmmaking
Event films
Photography
Post-production
Motion graphics
Colour grading
Sound design
Creative consulting
4. Quotations & Project Agreements
Quotations remain valid for a specified period, as stated on the quotation itself.
Production begins only after written approval of the quotation or proposal and receipt of the required deposit.
Where a project-specific contract exists, its terms take precedence over these general Terms in the event of any conflict.
5. Payment Terms
A deposit is required to confirm and schedule a production.
Additional payments may be tied to defined production milestones.
Final payment is due prior to delivery of completed work, unless otherwise agreed in writing.
Late payments may be subject to additional fees or delayed delivery.
Expenses beyond the agreed scope (e.g., travel, additional locations, extended hours) will be billed separately.
All fees are subject to applicable taxes.
6. Cancellation & Rescheduling
Clients may cancel a booking subject to the terms of their specific agreement.
Deposits are generally non-refundable once a production has been confirmed and resources allocated.
A kill fee may apply where a project is cancelled after production planning or execution has begun.
Rescheduling requests will be accommodated where reasonably possible, subject to availability.
The Studio is not liable for delays caused by weather, venue restrictions, or other circumstances outside its reasonable control (see Section 13, Force Majeure).
7. Client Responsibilities
Clients are responsible for:
Providing accurate and complete project information
Meeting agreed approval deadlines
Supplying any materials required for the production
Securing permissions and releases that fall under their own ownership or authority
Designating an authorized decision-maker for approvals during the project
8. Intellectual Property Rights
Studio Property
Unless otherwise agreed in writing, A L E K A M O I Studios retains ownership of raw footage, camera originals, audio recordings, editing project files, motion graphics project files, production templates, and other working files not delivered as final output.
Client Deliverables
Ownership or licensing of final deliverables transfers to the client upon full payment, as specifically outlined in the applicable production agreement.
9. Licensing & Usage Rights
Usage rights for delivered work are defined within each project agreement and may include, depending on what is agreed:
Social media
Website
Internal corporate communications
Television
Cinema
Advertising campaigns
Regional or worldwide distribution
Limited-term or perpetual licences
Any use of delivered work beyond the agreed licence requires prior written approval from A L E K A M O I Studios.
10. Revisions
Each project agreement specifies the number of included revision rounds.
Revision requests must be submitted clearly and within the agreed review period.
Additional revision rounds beyond those included may incur extra charges.
Requests that materially change the original scope or brief will be treated as new work and quoted separately.
11. Delivery & Archiving
Deliverables will be provided via the method agreed with the client (e.g., digital download, cloud link, physical media).
Files will be delivered in formats specified in the project agreement.
Delivery timelines are outlined per project and are dependent on timely client approvals.
Download links may only be available for a limited period after delivery.
Clients are responsible for maintaining their own backups of delivered files once received.
Archived project files are retained per the Studio's archive policy and are not guaranteed indefinitely.
12. Liability
A L E K A M O I Studios' liability is limited in relation to circumstances including, without limitation: equipment failure, technical malfunctions, venue restrictions, travel disruptions, utility outages, internet interruptions, third-party service failures, and data corruption occurring despite reasonable safeguards.
To the fullest extent permitted by law, the Studio's total liability for any claim arising from its services shall not exceed the total fees paid by the client for the relevant project.
13. Force Majeure
A L E K A M O I Studios shall not be held liable for delays or failure to perform obligations caused by events beyond its reasonable control, including but not limited to natural disasters, fire, flooding, public health emergencies, government restrictions, civil unrest, war, and utility failures.
14. Governing Law
These Terms are governed by the laws of Uganda, unless otherwise agreed in writing between the Studio and the client.
15. Changes to These Terms
A L E K A M O I Studios reserves the right to amend these Terms of Service at any time. Updated versions become effective upon publication on our website.
